जनप्रतिनिधित्व कानून का बढ़ता शिकंजा

लोकतंत्र को अपराधियों की छाया से मुक्त करने के प्रयास में सुप्रीम कोर्ट ने दस साल पहले एक अहम फैसला दिया था। लिली थॉमस बनाम भारत सरकार के मामले में सुप्रीम कोर्ट ने दागी निर्वाचित जनप्रतिनिधियों की सदस्यता बरकरार रखने का विशेषाधिकार समाप्त कर दिया था। जनप्रतिनिधित्व अधिनियम, 1951 की धारा 8(4) को असंवैधानिक करार दिए जाने के बाद भारतीय राजनीति के अपराधीकरण पर इसका क्या प्रभाव पड़ा है। कांग्रेस के नेता राहुल गांधी को मानहानि के मामले में दो साल की सजा मिलने के बाद और उनकी संसद सदस्यता निरस्त होने के कारण जनप्रतिनिधित्व कानून का यह प्रावधान एक बार फिर चर्चा में है। क्या है यह कानून और सुप्रीम कोर्ट के फैसले के बाद से राजनीति के अपराधीकरण पर इसका कितना प्रभाव पड़ा है और क्या इसमें फिर बदलाव की जरूरत है। इन सभी तथ्यों को ध्यान में रखकर इस कानून का विश्लेषण जरूरी है।
